The Brooklet Terms and Conditions

Please read the following terms and conditions carefully.

By you booking and confirming your accommodation at The Brooklet, you agree to these terms and conditions.

1) Introduction

In these terms and conditions:
(a) you or your means the guest making the booking and related parties.
(b) our, us or we mean The Brooklet and related parties.
(c) property, accommodation means The Brooklet, 841 Fernleigh Road Brooklet NSW 2479
As a guest, you agree to these terms and conditions when a booking is confirmed, and payment of deposit and/or final payment is made.

You agree that, should you or your guests breach any of the terms and conditions: You will pay to us the total loss or damage caused as a result of that breach and hereby authorise us to debit your pre-approved credit card and we may evict you and your guests without notice.

2) Bookings

Bookings at The Brooklet can be made via our website https://www.thebrooklet.com.au
or via email bookings@thebrooklet.com.au

Our policies are as follows:

50% non-refundable deposit to secure a booking.
final 50% non-refundable payment due 30 days prior to your arrival.
If booking is made within 30 days of arrival, full payment is due at time of booking.

You agree to pay the rate for each night of your stay prior to your arrival and any additional charges are to be paid prior to your departure.

3) Deposit and Final Payment

A non-refundable deposit of 50% is required at the time of confirmation. This can be paid via bank transfer, Visa or Mastercard. Use of credit cards incur a 1.5% charge.

A non-refundable final payment is required 30 days prior to arrival. This can be paid via bank transfer, Visa or Mastercard. Use of credit cards incur a 1.5% charge.

Bookings and payments must be supported with identification.

4) Payment Policy

Full payment is required at least 30 days prior to your arrival. If The Brooklet have not received payment, we reserve the right to cancel the booking.

In the event we must issue a refund via credit card, the refund must go back onto the original credit card charged.

5) Cancellation Terms and Charges

Your booking deposit and final payment is non-refundable.

Our cancellation terms are outlined below:

If you cancel 60 days prior to your arrival, you will receive a full refund.

If you cancel 31-59 days prior to your arrival, you will receive a 50% refund of your deposit.

If you cancel within 30 days of your arrival 100% of the total booking fee will be charged.

Written notification must be provided for all cancellations.

All cancellations will incur a $150 cancellation fee. We strongly recommend that you have travel insurance to cover you in the event of unforeseeable cancellations.

6) Coronavirus (COVID-19) Cancellation Policy

Currently, there are no restrictions on interstate travel to NSW for COVID-19. We ensure that all cleaning procedures are conducted to an extremely high standard. It is your responsibility to practise safe behaviours to help protect each other from COVID-19. Please stay COVID safe. Currently there are no restrictions for holiday home, short-term accommodation and small events in NSW, however we strongly recommend you keep up to date with current restrictions via Service NSW https://www.nsw.gov.au/covid-19.

We recommend that you have insurance to cover you in the event of unforeseeable cancellations.

7) Security Bond

The security bond for The Bails is: $1000.

The security bond for The Villas is: $1000.

The bond is held on a nominated credit card one week prior to check-in.

In the event of damage to the property, equipment, breakages, lost items or the property requiring extra cleaning your credit card will be debited.

Bond deductions are rare, however when they occur, we will advise you of details of any charges and these will appear on your statement.

Where the property is booked exclusively for a private event the security bond is: $5000.
The bond will be processed according to the arrangements made between us and you.

8) Rates and Charges

Rates and charges are quoted in AUD and are subject to change at any time.
Rates are inclusive of GST where applicable.

If a booking presides over the following periods – Easter, Christmas and New Year, the booking must be a least 3 nights minimum.

9) Digital Compendium

Once your booking has been confirmed and payment has been made, you will receive an email with your booking ID number. You will then be able to access our digital compendium app with all the details you require for you stay at The Brooklet

10) Check-in and Check-out

The property has the following check-in and check-out times.

Check-in 3.00pm

Check-out 10.00am

If there are any variations to these times, you will be advised accordingly prior to check-in.
We will try to accommodate requests for an early check-in however this is subject to availability. (i.e., other confirmed bookings, cleaners available to accommodate the request, maintenance schedule) and fees may apply. Despite an early application, approval will only be granted 1-2 days prior to arrival.

Check out is at 10.00am however guests can store their luggage and use the facilities until 12pm if required. This request must be pre-approved prior to arrival.

You are required to contact us 1-2 working days prior to your arrival date to confirm early check-in requests. If approved these notes will be recorded in your booking details.

11) Children (under the age of 16 years)

Children under the age of 16 years are not permitted in The Villas accommodation.

Children under the age of 16 years are not permitted in The Kitchen, The Barn, the 25-metre mineral Pool, Sauna, Ice Bath, Hot Tub, Gymnasium and Tennis Court.

Children under the age of 18 years are not permitted in The Bar.

Children under the age of 16 years are permitted in The Bails accommodation and The Bails pool, under adult supervision.

Please Note: If you are booking the property exclusively then children of all ages can access all accommodation – (The Villas and The Bails) and all facilities under adult supervision.

12) Number of Persons, Functions, Events and Parties

The property is for use by you and your booked guests only. No outside guests are permitted on the property without pre-approval from us. The number of occupants must not exceed the number of persons shown on your confirmation. Any increase in numbers must be agreed in advance and may incur additional fees.

No schoolies allowed.

No private functions, events or parties are permitted, unless otherwise agreed in writing prior to your arrival.
If a private function, event or party has been pre-approved by us prior to arrival, all guests must safely depart the property by 10pm

In the event we do pre-approve a private function, event or party, The Brooklet is the exclusive caterer for food and beverage. We do not permit other caterer’s, food vendors or beverage suppliers on the property. The Brooklet is a fully licensed venue and complies to all food safety standards and Responsible Service of Alcohol.

13) Noise and Behaviour

Excessive noise, general disturbance or anti-social behaviour is strictly prohibited.

We value and respect all our guests, our neighbours and surrounding community.

If a complaint of excessive noise or anti-social behaviour is received, a first warning will be given. If a second complaint is received, this will result in immediate eviction from the property without refund of booking fee or bond.

If a private function, event or party has been pre-approved by us prior to arrival, all musicians, DJ’s and entertainment must be pre-approved by us. Music turned down by 9pm. Background music permitted until 9.30pm. All guests to safely depart the property by 10pm.

NSW Fair Trading Code of Conduct for the Short-Term Rental Accommodation Industry

Guests who book premises located in NSW must abide by their responsibilities and obligations under the NSW Fair Trading Code of Conduct for the Short-Term Rental Accommodation Industry.

14) Inappropriate Bookings and Schoolies

We are considerate neighbours and responsible members of the local community. We reserve the right to refuse any bookings that we determine are for an inappropriate purpose, may cause excessive noise or general disturbance.

15) The Brooklet Facility Rules
(25 metre mineral pool, tennis court, gymnasium, hot tub, sauna, ice bath, treatment room)

All guests using our facilities do so at their own risk.
You acknowledge, we take no responsibility for accidents or injuries.

All accommodation, (including The Villas and The Bails) has access to all facilities.

No diving, running or pushing in the pool area is allowed.

Plastic glassware is provided, please do not use glassware in the pool area, hot tub, gymnasium, ice bath and sauna.
Children under the age of 16 years are permitted in The Bails accommodation and to use the private pool in The Bails, under adult supervision.

Children under the age of 16 years are not permitted in The Kitchen, The Barn, the 25-metre mineral pool, Sauna, Ice Bath, Hot Tub, Gymnasium and Tennis Court.

Children under the age of 18 years are not permitted in The Bar.

Please Note: If you are booking the property exclusively then children of all ages can access all accommodation and all facilities under adult supervision.

16) Disclaimers

We are not responsible for failure or interruption to power supply, water outages or services to the property for any reason beyond our control.

Property furnishings may be slightly different to those shown in the property photos. However, if they differ, the furnishings will be of the same standard or higher as that shown in the pictures.

The description of the property is given in good faith. From time to time, changes may occur at the property therefore we take no responsibility for irregularities or changes.

Your actions, conduct and safety are your responsibility of all guests. We do not condone unsafe, irresponsible or illegal actions/behaviour on or off the property, during your stay or at any other time.

As a condition of entering and/or staying at the property, you and all booked guests confirm that they understand and agree to indemnify us against any liability, damage, loss or action due to any actions, incidents, loss or injuries while within or outside of the property. Including the grounds, facilities and communal areas and structures during your stay or connected with your stay.

All bookings are made in good faith; however, we reserve the right to cancel any bookings due to unforeseen circumstances and refund you the full number of monies paid to date.

17) Changes Beyond Our Control / Force Majeure

Compensation will not apply if a significant change is made for reasons beyond our control. These include: war, threat of war, riots, civil disturbances, terrorist activity, industrial disputes, natural and nuclear disasters, fire, epidemics, health risks, changes due to rescheduling or cancellation of flights by an airline or alteration of the airline or aircraft type; closed or congested airports or ports, hurricanes, floods and other actual or potential severe weather conditions, act of government or public authorities or other circumstances amounting to force majeure and/or Acts of God.

18) Commercial Use

The property is not to be used for commercial use.

19) No Tenancy

This booking is not a residential tenancy agreement under the residential tenancy legislation.

You agree that regardless of your length of stay, there is no tenancy or other rights created under any landlord and/or tenant laws and there are no such laws that apply to your stay.

20) Parking

The property has ample off-street parking. Each accommodation(s) has private parking and are well signposted. Parking is at your own risk, and you agree you will not make any claim against us for any damages to your vehicle regardless of how or where the damage occurred.

21) Keypad Locks

Each accommodation has a unique secure keypad lock that requires a code for check-in.
You will be provided with details of the check-in process via a digital compendium app with a secure code that will be activated at your check-in time and deactivated at your check-out time for security purposes.

22) Linen

Linen, towels and pool towels are provided by the property.
Additional linen may be supplied on request during your stay. Additional fees may apply.

23) WIFI, Internet Access and Smart TV
The property is connected to Starlink. Internet access and WIFI are available for all guests.
Smart TV is available in all accommodation(s) please use your personal login details to access your preferred streaming service.

24) Cleaning

We request that guests leave the property as it was found to avoid extra cleaning charges.
This includes washing dishes, fridge emptied, placement of rubbish in the bins provided and BBQ cleaned. The cleaners will strip bed linen, so this is not required by you.
Additional cleaning charges may apply if the walls, floors, windows and/or linen are excessively dirty.
These charges will be deducted from your credit card.

25) Rubbish and Recycling

We require you to put all rubbish and recycling in the appropriate bins provided outside your accommodation prior to departure.

26) Breakages & Damages

In the event of breakages, damages or lost items, we request that you contact management as soon as possible to report the incident.
Breakages, damages or lost items to the property and/or communal external areas which are caused by any guest and/or a guest’s visitor will be deducted from your bond or supplied credit card if the charges are higher than the bond processed.

We have a strict policy on moving items or furniture, (indoor and/or outdoor) within the property. Movements may cause unnecessary damage to items and/or to the property and can cause excess cleaning time due to increased housekeeping inventory checks for replacement of items.
Any damages or excess cleaning caused by movement of items or furniture will be deducted from your bond.

27) Smoking and Vapes

For the comfort of all our guests, the property is non-smoking. Smoking inside any accommodation and around communal areas and facilities is strictly prohibited. If there is any evidence of smoking inside the accommodation you will be charged an additional $1000 for a specialised clean to eliminate odours. Vapes are not permitted inside any accommodation and around communal areas and facilities.

28) Fire and Emergency and Evacuation

Fire Certification will comply with the DA and regular checks will be made on all required fire safety compliance with appropriate licensed technicians.
Fire exits are clearly mapped and marked.
A detailed emergency plan: Director / Management oversees the regular review and updates to the plan. Director / Management oversee and ensure regular information updates and staff training for all staff around emergency and fire exit procedures. In the event of a fire and / or emergency, you agree to follow procedures outlined in your accommodation, compendium and instructed by management.

29) Animals and Pets

Pets are not permitted on the property and violation of these terms will incur additional cleaning fees, deducted from your bond and may result in immediate eviction.

30) Personal Belongings and Lost Property

You acknowledge that we do not cover your personal belongings under our insurance policy, and therefore take no responsibility for any loss or damage of your personal property while staying at the property or left on the premises. You also agree, you will not make any claim against us for any damages or loss to your personal belongings regardless of how or where the loss or damage occurred.
